Dear Sisters and Brothers,

We have, after many months of negotiating, agreed to and signed a Memorandum of Agreement (MOA) for the Citrus Combined Cycle Site (CCCS). The MOA will be released in its electronic version as soon as the parties are able to finish compiling the MOA language into a formatted and easy to read final product. The language that will be contained in the MOA has been ratified by the IBEW System Council - U8 Committee. Please see the summary of working conditions that follow. An actual hard copy contract will be printed as soon as possible.

Included in this news release you will find the CCCS Initial Staffing MOU document. I have included the Initial Staffing MOU inline for your convenience. I will post the final documentation on the IBEW U8 website as soon as possible.

I have confidence that this agreement will lay the foundation for membership and management in building a good working relationship for years to come at the CCCS and will also allow the parties to succeed in remaining leaders in safety, efficiency, and productivity at this site for decades.

I would like to thank all of the brothers and sisters that supported these negotiations for without your contribution, no matter how large or small, we could not have achieved this groundbreaking success.

Summary of conditions of labor at that CCCS:

Term of Agreement

  • 4 years, effective March 14, 2016.

Wages

  • CTT Wages identical to Main MOA
  • Combined Cycle Operator Trainee - $39.95/hr.
  • Combined Cycle Operator - $40.69/hr.
  • Future General Wage Increases tied to Main MOA negotiations.

Benefits

  • Same as the Main MOA

HR Policies and Procedures

  •  Same as apply to all IBEW SCU-8 employees

Staffing

  • Implements a new staffing model
  • Operations:  Created two new classifications - Combined Cycle Operator (CCO) and Combined Cycle Operator Trainee (CCOT).  CCOTs must possess a Journeyman skill in Operations and obtain a "Maintenance Progression" (new item) to become a CCO.  Maintenance Progression skills are those that are the most frequently performed in the Electrical, I & C and Mechanical disciplines, per a designated Task List.  CCOTs and CCOs will be required to perform maintenance and troubleshooting duties while on shift.
  • Maintenance:  Staffed with employees using the existing Combustion Turbine Technician (CTT) classification (No CTT4).   Management to specify the Journeymen skill needed for each CTT.   CTTs are required to obtain a progression skill in Operations.
  • Storeroom:  Staffed by Stores employees under the Main MOA and the South Region Stores MOU.
  • CCCS maintenance workforce may be supplemented with the System Maintenance Crew (SMC). 
  • Incorporates the existing CTT Development Program that was negotiated in the 2013 Main MOA, modified for the CCOT classification.

Seniority, Bidding and Rolling

  • Internal employees hired at Citrus will carry over and continue to accrue Production Department seniority.  This seniority can also be carried back over into the Main MOA.
  • After initial staffing (noted below) positions will be posted on the Duke web site.  Internal and external candidates will be considered simultaneously. Seniority will be only one component of selection.
  • After initial staffing, employees hired at Citrus are required to remain for a period of three years after becoming fully qualified. After the three year period, employees will be able to bid to positions in the Main MOA.
  • Employees will not be considered for positions in CCCS if they have any time-off discipline in their file.  Furthermore, employees may not bid out of CCCS if they have any time-off discipline in their file.
  • Employees are protected from being rolled for a period of three years after commercial operation of the second power block or October 31, 2021, whichever is sooner.
  • In the event of a reduction in force at CCCS, employees will have immediate rolling rights into the Main MOA.

Other

Except as provided below the remaining clauses of the Citrus MOA are identical or substantially similar to language in the Main MOA and/or the Hines MOA.

  • Streamlines the grievance procedure by removing the written first step process.  All grievances will be filed electronically.
  • Employees to maintain the call out list and administer call outs.  Call Out guidelines to be agreed upon later, similar to Hines.
  • Same vacations schedule as the Main MOA, with Management allowing 20% of Operations employees off at any one time.  Management will allow 33% of Maintenance employees at any one time.
  • All tools to be provided by Management

  • Shift Differential (Maintenance employees only) $.90 per hour for all hours worked between 6 pm and 6 am.
  • 12 hour schedules for Operations, 8 or 10 hour schedules for Maintenance.

Initial Staffing (Per separate negotiated Memorandum of Understanding)

  • Positions to be posted no later than February 29, 2016 
  • Company will post 24 Combined Cycle Operator Trainee (CCOT) positions and 6 Combustion Turbine Tech (CTT) positions both internally and externally.  Management will determine the Journeyman skills required for each CTT position.
  • Employees will have two calendar weeks to apply for the positions.  Applications must be submitted through the Company’s external web site.
  • Applicants must meet the following:
    • Pass or have passed the POSS test; and
    • Pass or have passed the MASS test at the I&C level; and
    • Have no “time off” discipline active in their file.
    • CCOT applicants must be qualified as a Journeyman Operator.
    • CTT applicants must possess at least the minimum qualifications of a CTT2 (one journeyman skill and two progression skills).
  • Qualified internal applicants will be awarded the position in the following order:
    • Main contract employees by Production Department seniority,
    • Hines Contract employees by Hines Plant seniority,
    • Applicants external to the IBEW SCU-8. 
  • Selected employees holding the title of CTT2 or CTT3 shall be placed at that same level into the Citrus Maintenance Department. 
  • Employees currently holding the title of CTT4 who are selected into CTT positions shall be placed into the Citrus Maintenance Department as a CTT3.  However, such employees shall be grandfathered into their current wage rate for the duration of their employment in the Maintenance department at CCCS. 
  • The Company will determine the employees’ start dates at CCCS and they may be required to remain in their current position until then.
  • Employees will have no bidding rights outside of CCCS from the time of selection until 3 years after commercial operation of the second power block or October 31, 2021, whichever is sooner.

Initial Staffing Memorandum of Agreement:

This MOU is agreed to between Duke Energy Florida, Inc. (“Company”) and the IBEW System Council U-8 (“Union”) regarding the initial staffing of the Citrus Combined Cycle Station (“CCCS” or “Plant”).

  1. By February 29, 2016, the Company will post 24 Combined Cycle Operator Trainee (CCOT) positions and 6 Combustion Turbine Tech (CTT) positions both internally and externally.  Management will determine the Journeyman skills required for each of the CTT positions.  Internal postings are covered by the provisions of this MOU.  Once posted, employees will have two calendar weeks to apply for the positions.  Applications shall be submitted through the Company’s external web site.  After this initial posting, any positions still unfilled will be filled in accordance with the CCCS Memorandum of Agreement.
  2. To be considered for these initial staffing positions, applicants must meet the following:
  1. Pass or have passed the POSS test; and
  2. Pass or have passed the MASS test at the I&C level; and
  3. Have no “time off” discipline active in their file.
  4. CCOT applicants must be qualified as a Journeyman Operator.  Scrubber Operators applying for CCOT positions will be assessed for a Journeyman Plant Operator skill.
  5. CTT applicants must possess at least the minimum qualifications of a CTT2 (one journeyman skill and two progression skills).
  1. Positions will be awarded in the following order:
    1. Qualified internal applicants from the Main MOA in Production Department seniority order;
    2. Qualified applicants from the Hines plant in Hines Plant seniority order; (Hines employees will be given Production Department Seniority based upon their date of selection)
    3. Applicants external to the IBEW SCU-8.  External candidates will only be considered if there are more positions than qualified applicants from a and b above. In this case, external candidates will be subject to the assessment and selection process agreed upon in Exhibit B of the CCCS Memorandum of Agreement.
  2.  All successful CCOT applicants will be assessed to determine level of competency for maintenance progression skills.
  3. Employees selected into CCOT positions shall be required to advance to Combined Cycle Operator (CCO).
  4. Selected employees holding the title of CTT2 or CTT3 shall be placed at that same level into the Citrus Maintenance Department.  If they do not already possess an Operations Progression skill, these employees will be required to obtain and maintain a CCCS Operator Progression Skill within 18 months. 
  5. Employees currently holding the title of CTT4 who are selected into CTT positions shall be placed into the Citrus Maintenance Department as a CTT3.  However, such employees shall be grandfathered into their current wage rate for the duration of their employment in the Maintenance department at CCCS.  Wages for these employees will continue to be subject to any General Wage Increase negotiated for CCCS.
  6. The Company will determine the employees’ start dates at CCCS and may do so in intervals. Until such time, the employees may be required to remain in their current position. If Plant Operators attain CCO qualifications before their start date at CCCS, they shall be paid at CCO rate of pay.  Scrubber Operators who successfully assess at Journeyman Plant Operator level and are subsequently selected as a CCOT will be paid at CCOT rate of pay at time of selection.  If Scrubber Operators attain CCO qualifications before their start date at CCCS, they shall be paid at the CCO rate of pay.
  7. As of their start date, employees will come under and be bound by the terms and conditions of the Citrus Combined Cycle Station/IBEW Memorandum of Agreement including the requirements of Exhibit B.
  8. Employees will have no bidding rights outside of CCCS from the time of selection until 3 years after commercial operation of the second power block or October 31, 2021, whichever is sooner.
  9. The Company will provide the training necessary to advance to the CCO position and will clearly identify the boundaries and scope of the skill set required.
  10. Employees selected into the CTT2 positions are not required to advance to CTT3. 
  11. Once trained to the CCO level, the employee is then considered qualified and no other advancement is required.
  12. Selected employees, both internal and external, may be required to attend training at a location selected by management. 
  13. Management will initially staff the CCCS storeroom by posting a storekeeper and an assistant storekeeper, per the requirements of the Main MOA. These positions will be headquartered at CCCS but will be governed by the Main Memorandum of Agreement and the South Region Stores Organization MOU and will remain within the Stores Seniority Group.

I am sure there will be questions. I ask that you direct your questions to your local Union’s negotiating delegate after you have been able to examine the contents of the memorandum of agreement when it has been finalized and posted.
